General Sales Terms and Delivery Conditions for Graph Druckula Edition Products

1. General 
All business relations between Graph Druckula and the customer are subject to the following conditions. The customer accepts these conditions by placing an order. Divergent, contrary or supplementary conditions become part of the contract only when Graph Druckula consents to them explicitly and in writing.

2. Conclusion of the contract 
The presentation of the product line on the website does not constitute an offer as defined in §§ 145 et seq. of the German Civil Code (BGB). By submitting an order via email, the customer submits a binding purchase proposal to Graph Druckula. Graph Druckula accepts the proposal by confirming the order. Should the product no longer be available, the customer is informed without delay and any payment made is promptly returned.

3. Prices 
All prices are subject to change without notice. Prices are listed in euros and inclusive of German sales tax. The cost of shipment, mail delivery, insurance, customs duty and import purchases tax is not included in the purchase prices listed. Errors and omissions excepted.

4. Payment 
Only one method of payment is available to customers: pre-payment by bank transfer onto our account. Orders are processed as soon as payment is received.

When transfering money from abroad, please make sure to always cite our BIC/IBAN codes. You can transfer money onto our account from abroad without payment of additional fees only on this condition.

Please do not engage in pre-payment by check. Graph Druckula is not liable for cash or checks lost in the mail. The settlement currency is the euro. The customers bears all expenses incurred by him in transfering payment. It is the customer’s responsibility to ensure that the full sum of the amount invoiced is received by us.

5. Delivery 
The product is delivered as soon as possible following receipt of the full purchase price and all delivery and supply costs by Graph Druckula. Where statements are made regarding delivery times, these are not binding, excepting special cases in which a binding commitment is made to a specific delivery date.
The customer assures provision of the correct and complete delivery address. The customer bears all costs arising from a culpably incorrect statement of the delivery address (such as additional delivery costs). 
Should the customer purchase several products within a brief time frame, these products can be delivered together on the customer’s request. The customer is, however, not principally entitled to such delivery.
Unless otherwise agreed, deliveries are posted from the facilities of Graph Druckula at the buyer’s risk and expense. The customers bears the risk as soon as the product has been handed over to the person responsible for dispatching it or as soon as it has left the warehouse of the contractor. The product is delivered as a parcel ensured up to a maximum of 500,- euros product value. Graph Druckula reserves the right to freely choose a particular parcel service.

6. Data protection 
The customer consents to his personal data being stored in a machine-readable format and accessed and /or processed for the purpose of fulfilling the contract. In particular, such data is employed for the purposes of issuing an invoice and delivering the order. Data is not made available to third parties or used for purposes other than the fulfilment of the contract.

7. Right of revocation 
The customer can revoke his contract within two weeks, without stating reasons, either in writing (e.g. via mail, fax or email) or by returning the product. The time limit of two weeks is calculated from receipt of this briefing and delivery of the product. The time limit is considered to have been respected if the written revocation or the product are posted within two weeks. The revocation should be addressed to:

Consequences of revocation 
In the case of an effective revocation, the goods and services rendered by both parties are countermanded and benefits drawn from these goods and services are returned. If the customer is unable to fully countermand the goods and services received or can countermand them only in a deteriorated form, he is obliged to provide compensation for lost value. This does not apply to objects provided whose deterioration is due only to their inspection such as it could have been undertaken by the customer in a shop.
Customers can avoid being obliged to provide compensation for lost value by not handling the object provided to them as if it were their property and avoiding all actions likely to reduce its value. The customer bears all expenses arising from the return consignment of a product that corresponds to the product ordered. If the product delivered does not correspond to the product ordered, the customer does not bear the expenses arising from return consignment. Cash-on-delivery shipments will not be accepted.
There is no right of revocation for products specially produced according to the customer’s specifications or clearly tailored to the customer’s personal needs. The same is true of products whose nature makes them unsuitable for return consignment.

8. Copyright and trademark regulations 
All brand labels and trademarks mentioned on the Graph Druckula website, including those reserved by third parties, are fully subject to the provisions of the relevant trademark legislation and the property rights of the registered owners. The copyright holder for all content on the Graph Druckula website is Graph Druckula. Further utilisation of any kind, either in whole or in part, requires the express consent of Graph Druckula.

9. Other 
These and all other relevant issues are subject to applicable law. Cases in which specific provisions of the sales contract or of these general sales terms are void do not affect the validity of the remaining provisions. Cross-border deliveries are subject to German law to the exclusion of the stipulations of the United Nations Convention on Contracts for the International Sale of Goods.

The court of jurisdiction and place of fulfilment is Berlin.
